DUTIES AND RESPONSIBILITIES
JOB DESCRIPTION:
The Department of Human Resources (HR) is in the Division of Business Affairs. The Director of Human Resources/EEO reports to the Chief Business Officer. This position is responsible for overseeing, planning, development and administration of all aspects of Human Resources including employment, recruitment and retention, benefits, performance management, employee relations, training, HR Banner system/data management and compliance with all applicable federal, state and local laws related to Human Resources. This position will also serve as the EEO/ADA Compliance Coordinator for the University and serves as the delegated appointing authority for all university employee discipline cases and oversees the duties of the Title IX Coordinator.
DUTIES & RESPONSIBILITIES:
Advises the University Senior Administration, managers and staff in areas related to HR.
Serves as the primary liaison on HR matters to campus governance groups including Faculty Senate and Staff Senate.
Oversees new employee orientation, mandatory training and development programs from the point of hire (orientation) through progressive professional growth and/or skill maintenance.
Provides leadership and oversight to the campus community on all employee benefit services including communications, coordination and customer oriented approaches.
Oversees and/or participates in campus recognition programs, campus festivities or HR activities to maintain and improve positive employee relations.
Creates and maintains standardized metric systems related to employee turnover, exit interviews and employee satisfaction surveys.
Directs the physical maintenance of all personnel records and actions.
Reviews Human Resource and EEO programs and determines need for new or revised policies and procedures.
Directs the implementation of these new policies and procedures.
Advises Employees and Counsels Administration on applicable state and federal laws, Civil Service and Board of Supervisors rules, as they pertain to employment.
Represents the university at Civil Service hearings, commission hearings, unemployment hearings, and other court hearings.
Investigates complaints filed and recommends to management a course of action.
Consults with legal counsel to address issues that may involve complicated legal ramifications.
Works directly with legal counsel in representing the university in employment matters.
Directs the development and implementation of programs in the area of employee relations, i.e. employee absence program (EAP), drug-free workplace, American with Disabilities Act (ADA), sexual harassment, Violence Free Workplace Act, etc.
Administers the worker?s compensation program for all employees.
Performs all duties of Delegated Appointing Authority, i.e. disciplinary actions, leave authorization, etc.
Serves on various committees assigned by the Chief Business Officer and/or the President.
Prepares periodic reports such as new hire, termination, promotion, and transfer.
Works with the Chief Business Officer and Budget Office in preparation of the fiscal year budget dealing with the personnel section.
Attends professional meetings and actively participates in professional organizations in the area of Human Resources.
Administers the Equal Employment Opportunity and Affirmative Action programs, and is designated as University Compliance Officer.
Adjudicates EEO/ADA employment issues filed by applicants or employees.
Adjudicates employment issues filed by employees in protected groups based on race, sex, age, color, religion, national origin, disability, etc.
Gathers evidence in civil, criminal, and other employment related cases to formulate defense or to initiate legal action.
Represents the university in court, and before quasi-judicial or administrative agencies of government such as Civil Service Hearings, EEOC, Office of Civil Rights, U.S. Department of Justice.
May participate in court proceedings against employees.
Arranges and conducts hearings to discover pertinent facts related to charges/complaints in accordance with federal and state laws and procedures.
Confers with University employees to obtain additional information bearing on appeals and to clarify future implication of decisions.
Serves on committees to hear unclassified and faculty appeals.
Conducts hearings to obtain information and evidence relative to disposition of employee appeals.
Calls upon witnesses to testify at hearings.
Questions witnesses and rules on exceptions, motions, and admissibility of evidence.
Analyzes evidence and applicable law, regulations, policy, and precedent decisions to determine appropriate and permissible conclusions.
Renders decisions affirming or denying previous decisions, based on testimony, claims, records, applicable provisions of law, and established precedents.
Writes decision explaining rulings and informs interested parties of results.
Studies the U.S. Constitution, the State Constitution, Civil Service Rules, decisions, and ordinances on quasi-judicial bodies.
Answers employee questions regarding rights and benefits and advises on how rules apply to individual situations.
Presents arguments and evidence to support appeals at appeal hearings.
Researches laws, regulations, policies, and precedent decisions to prepare for appeal hearings.
Schedules hearings, counsels parties, and administers oaths to prepare for formal hearings.
Reviews union contracts and makes recommendations for changes as needed.
May advise administrators and faculty and staff inventors concerning patentability of inventions, infringement of patents, validity of patents and similar items.
Assists with applications for patents and presents applications to the U.S. Patent Office.
May advise administrators and prepare opinions on tax liability for the University resulting from prospective and past transactions.
Examine legal data to determine advisability of defending or prosecuting lawsuit.
May prosecute for or defend the University in patent infringement litigation.
May draw up legal documents.
Reviews and assist employees and management with complicated contacts.
Advises University administrators of legal rights, practices.
May assist in preparing and conducting criminal and civil lawsuits.
Conducts research on legal topics.
Performs any and all other duties as assigned by the Chief Business Officer and/or the President.
QUALIFICATIONS AND SKILLS
Education, Experience, & Preferred Qualifications:
Masters or Professional degree in business or related field preferably Human Resources/Personnel from an accredited university and legal experience dealing with HR & EEO laws and regulations. Juris Doctorate preferred. Minimum of 5 years of professional-level human resources experience, including at least 3 years of supervision of staff and including 5 years of EEO related experience. The ability to present facts and recommendations effectively in oral and written form. Working knowledge of Microsoft Office related software. Knowledge of state and federal legislation and regulations pertaining to personnel matters. Working knowledge of the Americans with Disabilities Act of 1990 and other EEO related legislation. Must be committed to working with diversity. Preferably knowledge of the Louisiana State Civil Service Rules and participation in SHRM (Society for Human Resource Management).
SALARY
Commensurate with experience.
